Another great win on unpaid meal breaks

ASMOF has had another win in our campaign to get Local Health Districts to properly pay medical officers (DiTs) when they take a meal break.

The ISLHD has corrected their roster templates effective from 24 March 2019 to ensure meal breaks are paid in line with the Public Hospital Medical Officers Award 2019.

The LHD has also:

  • agreed to back-pay all DiTs who had been underpaid for meal breaks incorrectly rostered as unpaid meal breaks rather than paid meal breaks since the Health Roster Go Live date 26 March 2017
  • confirmed they will not review or seek to recover overpayments if they occurred because a meal break was not required to be paid.

This is a great collective win.

But if any member believes that on top of this they have still been underpaid they can request a review of their shifts over the last six years. Please contact the Union at allocation@asmof.org.au if you have any questions about this.

For members at SWSLHD that payments will be staggered across four pay periods:

  1. Bowral & District Hospital, Mental Health Service and Primary & Community Services – 15 August 2019
  2. Liverpool Hospital – 12 September 2019
  3. Fairfield Hospital and Bankstown Hospital – 26 September 2019
  4. Camden and Campbelltown Hospitals – 24 October 2019

We are continuing to work with NBMLHD, NSLHD and CCLHD to finalise outstanding claims.

What else do you need to know:

  • You are entitled to a paid meal break for shifts other than day shifts Monday to Friday. For day shifts Monday to Friday, an unpaid meal break continues to apply unless requested and required to work
  • Check your pay and transaction reports to ensure that you have been paid the retrospective payment
  • Pass this information onto your colleagues and encourage those who are not members to join the Union.
