Local policies for claiming overtime



Your employer is permitted to create guidelines around when overtime should be submitted. These guidelines should be adhered to wherever possible. However, these guidelines do not override an employee’s right to make a claim under the relevant Award. Strictly speaking, an employee has six (6) years to make a claim under the statute of limitations. Nevertheless, from a legal perspective, the greater the delay, often the more problematic it becomes to substantiate that claim. Consequently, we always recommend doing so as soon as possible.
