Parental Leave Portability – Win!

ASMOF refers to our recent news articles available here and here regarding the NSW Ministry of Health’s proposed Determination on Parental Leave Portability for Junior Medical Officers.

Our feedback to the Ministry on 31 July 2019 is available here.

In response to our changes requested, the Ministry has advised ASMOF that they:

  • Agree to specify entities who may direct the medical officers’ training;
  • Are unwilling to remove the requirement that the placement be “directed”;
  • Maintain that a requirement for supporting documentation will remain;
  • Have included a note that the Determination is not intended to restrict or contract out of Award and Legislative requirements.

The Ministry has also advised ASMOF that this Determination 19 of 2019 available here, will have effect from 5 August 2019 and will provide access to paid maternity, paternal and adoption leave to those Medical Officers on an accredited medical rotation where continuity of service would have otherwise been broken.

The Ministry has also agreed to ASMOF’s request to publish this entitlement in the next update of the NSW Health Employment Arrangements for Medical Officers in the NSW Public Health Service Policy Directive PD2019_027.

ASMOF acknowledges not all changes we requested were adopted by the Ministry. However, we also acknowledge that the recent changes achieved as a result of ASMOF’s prompt feedback and strategic multi-disciplinary campaign to win positive changes to parental leave provisions for medical officers in NSW - is a significant improvement for JMOs.

ASMOF will continue to work with JMOs to seek recognition of JMOs who volunteer (not directed) for rotations and all other changes we had previously requested. We encourage all medical officers to continue to give us any feedback you have (including challenges) regarding seeking access or recognition of parental leave provisions in your workplace.
